I just read this article by some dude going on about why the Feds can't order a nation wide standard for treating things like this Ebola quarantine deal like the one that Cuomo and Christie back tracked on because the Whitehouse suggested it was too harsh.
The guy seemingly goes out of his freakin' way to hint at it but never quiiiiite says why the Feds have their hands tied.
It's a long article too.
He just says that the Framers of the Constitution designed it that way, yadda yadda yadda, Federalist system, blah blah.
Dude, really?
Could you not like, GOOGLE THE SUBJECT? Ever heard of Wikipedia?
The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.
Dayum.
It's not like seven out of ten people under forty have no clue what is in the Constitution anymore anyway.
That number goes down to almost zero the younger they are.
There are full grown adults that were born and educated here that can't even name the three branches of government for fucks sake!
It makes me want to scream when I see crap like this.
If you can muster enough words blathering on about why Obama can't just decree quarantine standards for the whole country like he would love to do, at least explain why in plain enough language that the average moron in this country can understand.
It would be the right thing to do.

You are aware that the federal government, in the past, initiated quarantine standards relative to people entering the United States. The feds have the power to do so for both Immigrants and probably also for returning U.S. Citizens. It would almost definitely be upheld by the Supreme Court if it came to that if only because the federal government has very broad powers when virtually anything involves someone coming across our borders. For example, the 4th amendment pretty much goes out the window for Customs Searches and it has been upheld that Customs Officials can perform a Customs search of a person based upon something as little as a hunch. If it comes down to protecting the population against an outbreak of a deadly disease, the federal government can move to quarantine people as evidenced by the plague houses on the islands in NY Harbor in years gone bye. Now while such authority may seem to only apply to the border, this authority may also extend beyond the borders and to the interior of the nation in as much as they may have authority to quarantine anyone who might travel across state lines much the same way that that is what gives the FBI authority to investigate certain crimes. As far as folks coming into the country from abroad though, that the feds have the authority to quarantine them - there is alsmost no doubt in my mind.
